"AI Recruiting Solution"


By using our "AI Recruiting Solution", you agree to the following terms of use.


1. Scope


1.1. MediaMarktSaturn Retail Group GmbH (hereinafter: "MediaMarktSaturn," the "Provider," or "we") provides potential applicants (hereinafter: the "User" or "you") with the "AI Recruiting Solution" (hereinafter: "AI Recruiting Solution" or the "Tool"). The Tool serves as an AI-powered software solution to make the application process more efficient and user-friendly through automation and artificial intelligence (hereinafter: "AI"), and to optimize the applicant experience. You have the option to transmit data to the "AI Recruiting Solution" via microphone or text input (hereinafter: "Inputs"). Based on these Inputs, the system generates content (hereinafter: "Outputs").

The Tool includes the following functions:

    1.1.1. AI-supported Interview: Conduct a virtual interview, including answering your questions using pre-defined answers to frequently asked questions (FAQ), creating a transcript of the interview, and a summary of the conversation.

    1.1.2. Automated Evaluation: Fully automated analysis and evaluation of your inputs in the interview, which serves as a basis for decisions on whether to continue with the application process. The evaluation of your inputs is based on clearly defined and neutral assessment criteria, which are established based on the company's principles, the respective job profiles, and the competencies required for the respective role.

    1.1.3. Resume Draft: Assistance in creating a resume based on your inputs.

The Tool also serves for the pre-qualification of applicants to enable a more efficient and objective initial assessment. Final decisions about hiring or rejecting applicants will continue to be made by humans.

You are not required to use the "AI Recruiting Solution." To apply to us, the classic application form via our job postings on the careers page is still available. You will not be at a disadvantage whether you use the "AI Recruiting Solution" or the classic application form.

1.2. Responsible for the operation, technical implementation, and continuous development and improvement of the "AI Recruiting Solution" is:

For its provision, the Tool accesses the Google Gemini API.


2. User's Obligations


2.1. Minimum Age

You must be at least 16 years old to use the "AI Recruiting Solution." If you are under 16, please use the classic application form via our job postings on the careers page.

2.2. Technical Requirements

To use the "AI Recruiting Solution," you need a current internet browser, a stable internet connection, and a functional microphone. You are responsible for the availability and functionality of these yourself. No warranty is given for the compatibility of the Tool with the hardware and software used by the user.

2.3. Notes on Conducting the AI-supported Interview

    2.3.1. Before you begin the AI-supported interview, choose a quiet place where you can speak freely and without interruption. Plan for about 30 minutes for the interview.

    2.3.2. As in a classic in-person interview, it is not possible to pause the interview and continue it at a later time. The interview will be automatically terminated after a total inactivity of 30 minutes.

2.4. Required Information for Use

To use the "AI Recruiting Solution," you must provide your email address. This is used as a means of authentication. When you access your candidate profile, a link will be sent to the email address you provided. By clicking this link, you will gain access to your personal candidate profile. To submit the application and create the resume, further information is required (e.g., first name, last name, address, country of residence, and phone number).

    2.4.1. There is no entitlement to use the service. If the "AI Recruiting Solution" cannot be used, please use the classic application form via our job postings on the careers page.

    2.4.2. The information provided must be truthful.

    2.4.3. The "AI Recruiting Solution" may only be used for oneself. No third-party data may be used, nor may the "AI-Recruiting-Solution" be used on behalf of third parties.

    2.4.4. Multiple applications for the same position with the same email address are technically not possible.

2.5. Confidentiality of Access Data

    2.5.1. You are responsible for protecting your email account from access by third parties.

    2.5.2. If you become aware that third parties have gained access to your email account, thereby creating a risk of unauthorized access to your candidate profile, you are obliged to inform us immediately.

2.6. Inputs and Prohibited Uses

    2.6.1. You are responsible for the accuracy of your data and your inputs.

    2.6.2. When using the "AI Recruiting Solution," you are specifically prohibited from:
      a. Using a false identity;
      b. Using technologies to conceal your identity (e.g., VPN, fraud software);
      c. Making false or misleading claims regarding your expertise, skills, or experience with deceptive intent;
      d. Manipulating the Tool through misleading information or in any other way;
      e. Causing the Tool to generate personal data of third parties or Confidential Information as defined in Section 7.1 that does not serve the purpose of the application, by designing inputs, circumventing technical safeguards, or otherwise.

    2.6.3. When using the "AI Recruiting Solution," you are not permitted to enter into the Tool, or have the Tool generate, data that does not serve the purpose of your application, in particular:
      a. Confidential Information as defined in Section 7.1;
      b. Personal, sensitive data (e.g., passwords, origin, religion, health, sexuality);
      c. Content that glorifies violence, promotes terrorism, or is otherwise illegal (e.g., hate speech, discriminatory content);
      d. Content related to sexual abuse or exploitation, especially of children;
      e. Content that promotes self-harming behavior;
      f. Content that enables illegal activities or violations of laws;
      g. Content that violates legal regulations and/or infringes the rights of others, including the right to privacy and data protection, as well as industrial property rights and copyright, e.g., by using personal or biometric data without the legally required consent.

    2.6.4. You are not permitted to impair or disrupt the functionality and operation of the Tool or to endanger the security of the Tool, in particular through hacking, malware, viruses, spam or phishing software, or by circumventing protective measures against misuse or security filters. You are also prohibited from making an unusually high number of inputs in a short time or automated inputs.

    2.6.5. You are not permitted to reverse engineer, extract, or replicate components of the Tool.

    2.6.6. Please note that the use of the Tool is monitored for the purpose of abuse detection. If violations are detected, appropriate security measures may be taken (e.g., outputs may be blocked). In individual cases, relevant information may be forwarded to us. Violations may have civil or criminal consequences.


3. Obligation to Review the Outputs of the "AI Recruiting Solution"


3.1. You acknowledge that the outputs are merely assumptions made based on probabilities and that their quality depends in particular on the quality of your inputs. The outputs are generated based on probabilistic models (Google Gemini) and may—despite all measures taken and the observance of due care—be incomplete, incorrect, or unsuitable for the intended purpose in individual cases, contrary to the objectives of MediaMarktSaturn. The outputs of the "AI Recruiting Solution" do not necessarily reflect the views of MediaMarktSaturn.

3.2. You are obliged to independently and carefully check all outputs (including the resume provided at the end of the interview) for accuracy, completeness, and legality. You can edit, supplement, or shorten the resume before it is submitted to us for the purpose of the application. Please note: Changes made to the resume afterwards will no longer be included in the AI's evaluation of the interview previously conducted with you.

3.3. Any use of the outputs is at the user's own risk. We do not guarantee the accuracy, completeness, timeliness, or reliability of the outputs and—subject to the provisions in Section 10—are not liable for damages caused by the use of or reliance on the outputs.


4. Cost


The use of the "AI Recruiting Solution" is free of charge for you. You are responsible for the costs incurred in establishing and maintaining the technical requirements mentioned in Section 2.2.


5. Rights of Use


5.1. We grant you a non-exclusive and non-transferable or sublicensable right to access and use the "AI Recruiting Solution" via the internet for the purpose of the AI-supported application.

5.2. To the extent that the inputs are protected by copyright, you grant us a non-exclusive, perpetual, worldwide, transferable, and sublicensable right to use, reproduce, and incorporate the inputs into other data collections and databases of MediaMarktSaturn, to combine, edit, and/or use them within the technologies used by MediaMarktSaturn, as far as this is necessary for processing your application, and for the other purposes formulated (in compliance with the data protection notice). To the extent that the inputs are not protected by copyright, you grant us the actual authority to use, reproduce, and incorporate the data into other data collections and databases of MediaMarktSaturn, to combine, edit, and/or use them within the technologies used by MediaMarktSaturn for the purpose of AI-supported management and processing of your application.

5.3. At the time of conclusion of the contract, we assume that the outputs do not enjoy copyright protection. To the extent that the outputs are not protected by copyright, MediaMarktSaturn alone is authorized to use them. We grant you the actual authority to use the outputs for the purpose of your application with us. To the extent that copyright protection exists or arises in the future for the outputs, the rights of use thereto shall also belong exclusively to MediaMarktSaturn. We grant you a simple, non-transferable, or sublicensable right to use the outputs for the purpose of your application with us.


6. Data Protection


The protection of your privacy and your personal rights is our highest priority. Therefore, we place special emphasis on a responsible, careful, and fair handling of your personal data.

When you use the "AI Recruiting Solution," MediaMarktSaturn will generally only use the content you send to the "AI Recruiting Solution," as well as all outputs, to the extent necessary to provide our content and services and to carry out the application process via the "AI Recruiting Solution." The processing of special categories of personal data is not necessary for conducting the interview via the "AI Recruiting Solution." Therefore, we urge you not to enter any information regarding your health, racial or ethnic origin, religious or philosophical beliefs, political opinions, or trade union membership, as well as your biometrics, genetics, or sexual orientation/interests into the tool during the interview. Such personal information will be blocked by the "AI Recruiting Solution."

7. Confidential Information


7.1. You undertake to use all facts obtained during the use of the Tool that relate to our individual business, financial, technical, or other affairs, in particular data and information relating to technologies, products, services, prices, know-how, and work results, and which are explicitly marked or designated as "confidential" or whose confidential nature is apparent to you as the recipient of the information from the context, regardless of whether the information is disclosed in oral, written, or electronic form ("Confidential Information"), only for the purpose of your application to us and otherwise to keep them secret. Confidential Information may not be disclosed to third parties without our prior written consent.

7.2. The obligation of secrecy does not apply to information that (i) is public knowledge or generally known, (ii) is made available to the recipient of the information by third parties, if and to the extent that the third party does not thereby violate a legal or contractual obligation of secrecy; or (iii) must be disclosed due to an enforceable order of an authority or a court. The burden of proof for the existence of one of these exceptions lies with the recipient of the information. If the recipient of the information is or is to be obliged to disclose confidential information due to an enforceable order of an authority or a court, they must notify us immediately and limit the disclosure to the mandatory minimum.


8. Availability


There is no entitlement to the use or the continuous availability of the "AI Recruiting Solution." We do not guarantee uninterrupted availability of the "AI Recruiting Solution." Maintenance work, technical disruptions, or force majeure may lead to temporary restrictions or failures. For applications with an imminent submission deadline, please always use the classic application form via our job postings on the careers page.


9. Blocking of Access


We are entitled at any time to block access to the Tool permanently or temporarily without giving reasons, in particular if:

9.1. You have provided false information;

9.2. You have violated these terms of use or legal provisions;

9.3. You have not used the access for a period of more than 12 months; or

9.4. There is a suspicion of fraudulent third-party use of the access.


10. Liability


Our liability is governed by statutory provisions, unless otherwise specified below:

10.1. We are liable in accordance with statutory provisions for:

    10.1.1. Damages that we cause intentionally or through gross negligence,

    10.1.2. Damages whose non-occurrence we have guaranteed,

    10.1.3. Damages resulting from a defect fraudulently concealed by us,

    10.1.4. Damages for which we are liable under the Product Liability Act,

    10.1.5. Damages to life, limb, and health for which we are responsible.

10.2. For property damage and financial losses caused by slight negligence, we are liable as follows: If the damage is based on the breach of a contractual obligation, the fulfillment of which makes the proper execution of the contract possible in the first place and on whose compliance the user was entitled to rely (so-called cardinal duty), liability is limited to typical contractual damages, i.e., damages foreseeable at the time of the contract conclusion when applying customary diligence.

10.3. If the property or financial damage is based on the slightly negligent breach of a contractual obligation that is not a cardinal duty within the meaning of Section 10.2, liability is excluded.

10.4. We and you are not liable, in particular, for the non-fulfillment of obligations if the non-fulfillment is due to force majeure. Force majeure exists in the case of an external event that is extraordinary and unavoidable, such as operational disruptions, riots, war, natural disasters, political unrest, pandemics, official orders, and other unavoidable events. As long as force majeure exists, the obligation to perform is suspended.

10.5. We are not liable, in particular, for the loss of your data to the extent that the damage is due to your failure to perform data backups and thereby ensure that lost data can be restored with reasonable effort.


11. Final Provisions


11.1. Applicable Law

The law of the Federal Republic of Germany shall apply.

11.2. Jurisdiction

The place of jurisdiction, if the user is a merchant within the meaning of the German Commercial Code (Handelsgesetzbuch), a legal entity under public law, or a special fund under public law, shall be Ingolstadt, subject to any deviating exclusive place of jurisdiction.

11.3. Reservation of Right to Amend

These terms of use come into force in their present version on 19.11.2025 and are valid until a more current version comes into effect. We reserve the right to make changes or additions to these terms of use. Changes to these terms of use will be sent to the email address you provided when using the Tool, with the new version attached. Before the next use of the Tool, your consent to the amended terms of use is required, e.g., by clicking on a corresponding confirmation.

11.4. Severability Clause

Should any of the provisions of these terms of use be or become invalid, the validity of the remaining provisions shall not be affected thereby. In this case, the parties shall replace the invalid clause with a valid one that comes as close as possible to the economic purpose and intent of the invalid clause.
